“Business Owner” refers to users who manage employees and shifts via the web admin portal.
“Employee” refers to users who are invited by a Business Owner to use the app.
2. Account Registration
2.1 Business Owners
- To use the Services, you must create an account and provide accurate, complete information.
- You are responsible for maintaining the confidentiality of your account credentials.
2.2 Employees
- Employees can only register after receiving an invitation code from their employer.
- You agree to use the Services in accordance with your employer’s policies.
3. Use of the Services
3.1 Permitted Use
- You may use the Services for lawful business purposes only.
- Business Owners are responsible for managing employee access and ensuring proper use of the app.
3.2 Restrictions
You agree not to:
- Reverse engineer, decompile, or disassemble the Services.
- Misuse the Services or interfere with their functionality.
- Share or distribute any content that is harmful, illegal, or violates privacy rights.
4. Fees and Payments
- Subscription Plans: Business Owners can subscribe to different plans as outlined on our Pricing page.
- Billing: Payments are processed through Stripe or other approved payment providers.
- Changes to Plans: You can upgrade or downgrade your plan by contacting our support team at support@presentpro.com.au.
- Refunds: All payments are non-refundable unless otherwise stated in our Refund Policy.
5. Privacy Policy
Your use of the Services is subject to our Privacy Policy. By using the Services, you consent to the collection and use of your data as described in the Privacy Policy.
6. Termination
6.1 By You
You can terminate your account at any time by contacting support@presentpro.com.au.
6.2 By Us
We may suspend or terminate your access to the Services if:

Upon termination, your access to the Services will be disabled, and any associated data may be deleted.

To the fullest extent permitted by law, Present will not be liable for:
- Any indirect, incidental, or consequential damages.
- Loss of data, revenue, or profits resulting from the use or inability to use the Services.
Our total liability under these Terms is limited to the amount you paid for the Services in the past 12 months.

You agree to indemnify and hold harmless Present, its employees, and partners from any claims, damages, or losses arising from:
- Your use of the Services.

11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts in Sydney, NSW.
